Does preservation mean the material will automatically be disclosed?¶

No. Preservation and disclosure are separate stages.

Avoid this assumption: Once a provider or organisation confirms preservation, investigators will automatically receive the material. Preservation usually means identified records are retained against routine deletion for a limited purpose or period.

Disclosure may still require separate lawful authority, organisational approval, court process, provider procedure or communications-data route.

The preserved material may include categories that were not visible to the account holder, but that does not make them immediately accessible.

Record the preservation reference, scope, date range, categories, expiry and any stated conditions.

Confirm what follow-on process is required and who is responsible for completing it.

Do not allow the preservation period to expire while waiting for authority or paperwork.

Where the provider is outside the jurisdiction, different processes and timescales may apply.

Preservation also does not guarantee that the provider held the requested material, identified the correct account or retained every relevant category.

A later disclosure may be narrower than expected, redacted, incomplete or technically formatted.

Keep local preservation active. Devices, screenshots, organisational logs, witness evidence and account context may still be necessary.

Do not tell victims, witnesses or decision-makers that the evidence has been obtained merely because it has been preserved.

Record any refusal, limitation, extension or lapse.

Record the deadline for the follow-on application and any provider instruction needed to maintain the preservation.
