What can an SMS message actually prove?

An SMS message may appear straightforward: a number, some text and a time.

Evidential caution: that the handset display proves who wrote the message, who received it and what the network retained.

What this means

An SMS can help show that particular text was associated with a sending and receiving number or device at a recorded time. On a handset, it may preserve the message content, apparent sender, recipient and local status.

That can be important evidence of threats, instructions, contact or timing.

The sender information may also be misleading. Some SMS traffic uses alphanumeric sender IDs or internet-based gateways, and sender details can sometimes be spoofed.

Handset timestamps may differ from network records. The device may show local time, while provider systems may record network events separately.

Report the evidence at the level it supports. “This handset displayed the message” is different from “This person sent it.”

What to check or do next

  • Preserve the original device where proportionate, along with screenshots, message details, contact information and any associated notifications.
  • Compare the SMS with surrounding communications, device possession, SIM and IMEI data, account activity and witness evidence.

Evidential limits

But the visible message does not automatically identify the human author. A handset may be shared, borrowed, stolen or remotely accessed. The subscriber may not be the user.

Seek provider records where lawful and necessary. These may help establish network transmission events, subscriber information and device associations, but they may not include the message content.
