What does an SMS delivery report prove?¶

An SMS may show a delivery report or a status indicating that it reached the destination.

Evidential caution: that delivery proves the intended person read the message.

What this means¶

An SMS delivery report usually reflects a network or service event showing that the message reached the destination handset, subscription or messaging system defined by the service.

A shared, lost or unattended handset may still receive the message. A device may also generate a notification without the user becoming aware of it.

The exact meaning of the status depends on the handset, network and messaging implementation. A displayed symbol should not be interpreted by assumption alone.

In reports, “The service recorded the SMS as delivered” is usually safer than “The recipient received and read the SMS.”

What to check or do next¶

• Preserve the delivery status, time, service, number and device. Where necessary, compare the handset display with network records.
• Look for stronger evidence of awareness: a reply, later reference to the content, conduct consistent with receipt, witness evidence or access to the device.
• Preserve the source and collection method so another investigator can test the same interpretation.

Evidential limits¶

It does not prove that the phone was in the intended person’s possession. It does not prove that the screen was viewed, the message was opened or the content was understood.

Remember that the absence of a delivery report does not prove non-delivery. Delivery reporting may be disabled, unsupported or delayed.
