What should investigators avoid overstating about encrypted messaging?¶

Encrypted messaging often attracts absolute claims.

Evidential caution: that encryption either makes investigation impossible or guarantees complete privacy.

What this means¶

Equally, do not claim that every backup, notification or linked device will contain readable content. Availability varies by service, settings, timing and retention.

Where provider behaviour matters, verify the current service position rather than relying on older assumptions.

What to check or do next¶

• Do not say that the provider must hold the messages because the participants can see them.
• Preserve the source and collection method so the conclusion can be reviewed and reproduced.

Evidential limits¶

Do not say that no evidence exists simply because the provider cannot read the content.

Do not assume that content recovered from a device means the encryption failed. The device is an endpoint where the message is intended to be readable.

Do not assume that metadata proves the content or authorship of the communication.

Do not assume that an encrypted account was controlled by its registered owner. Shared devices, linked sessions and compromise remain possible.

Do not assume that deletion or disappearing-message settings removed every copy.

State what the evidence actually shows: the account involved, the device or session, the message content recovered, the provider records obtained and the remaining uncertainty.

Encryption changes where investigators should look and what a provider may be able to supply. It does not remove the need for careful attribution and corroboration.
