Could messaging or telecoms provider records disappear quickly?¶

Some provider-held records may exist only for a limited period.

Evidential caution: that the material can be requested later without loss.

What this means¶

Retention varies by provider, service, record type, jurisdiction and account configuration.

Security logs, session records, message metadata, deleted-account information, temporary content and customer-service records may be retained for different periods.

A user may also delete an account, remove linked devices, leave a group or change identifiers while the investigation is developing.

The provider may preserve operational records only until they are overwritten or no longer required.

Continue pursuing endpoint devices, recipient copies, organisational systems and backups rather than relying entirely on the provider.

Where delay has already occurred, ask the provider to explain retention and whether earlier records are no longer available.

Where the scope is disputed, record why each requested field is relevant to the investigative question.

What to check or do next¶

• Identify volatile records early and consider a lawful preservation request where appropriate.
• Preserve the account, number, group, message, device and date identifiers before they change.
• Record when the provider was contacted, what identifiers were supplied and what period was preserved.
• Preserve the source and collection method so another investigator can test the same interpretation.

Evidential limits¶

Do not assume that a preservation request guarantees every record exists or will be supplied. It generally protects material already held and within the scope of the request.
